Welcome to Waytofilm. These Terms and Conditions ("Terms") govern your use of our website and the purchase of our services, including studio memberships, photo and video sessions, content production, and equipment rental.

By accessing this website, you agree to be bound by these Terms, all applicable laws and regulations in the State of Florida, and agree that you are responsible for compliance with any applicable local laws.

1. Services and Bookings

Waytofilm offers studio memberships (photo and video sessions), content production services, and professional equipment for content creation.

  • All bookings are subject to availability and written confirmation.
  • Quotes provided via the website are estimates and may be subject to change based on specific requirements.

2. Intellectual Property

The materials contained in this website, including logos, designs, text, and images, are protected by applicable copyright and trademark law. You may not reproduce, distribute, or use any content for commercial purposes without express written consent from Waytofilm.

3. SMS Terms & Conditions

By providing your phone number and opting in to receive messages, you agree to the following:

  • Message Types: Appointment reminders, order alerts, service updates, and account notifications.
  • Consent: Consent to receive automated marketing text messages is not a condition of any purchase.
  • Frequency: Message frequency varies.
  • Rates: Message and data rates may apply.
  • Opt-Out: You can cancel the SMS service at any time. To opt out, text STOP. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed.

Opt-In Method: You may opt in to receive SMS messages through one of the following methods: by filling out a paper form or through our website.

4. Payments and Cancellations

  • All payments are processed in USD.
  • Specific cancellation policies for memberships or sessions will be detailed in your individual service contract.

5. Limitation of Liability

Waytofilm shall not be liable for any damages arising out of the use or inability to use the materials on this website or for delays in SMS delivery due to carrier issues.

6. Indemnification

You agree to indemnify and hold Waytofilm harmless from any demands, loss, liability, claims, or expenses (including attorneys' fees) made against them by any third party arising out of or in connection with your use of the website or any of the services offered.

7. Modifications

Waytofilm may revise these Terms at any time without notice. By using this website, you agree to be bound by the then-current version of these Terms and Conditions.

Membership Service Terms and Conditions

By clicking "Accept" and subscribing to any of our membership plans, the user agrees to the following Terms and Conditions. These Terms constitute a legally binding agreement between the Member and Waytofilm.

1. General Subscription Conditions

1.1. Minimum Duration: Each subscription is subject to a mandatory minimum commitment of six (6) months from the service start date.

1.2. Plan Scope: The included services are strictly limited to the number of photos, videos, outfit changes, and sets detailed in the selected Plan.

1.3. Studio Availability: The studio is available to members only from Monday to Thursday, subject to schedule availability. Booking is done via our booking system or by contacting us directly through WhatsApp.

1.4. Content Delivery: Edited content will be delivered within a maximum of two (2) to three (3) business days after the session, as specified in the Plan details.

2. Session Cancellation and Rescheduling Policy

2.1. Cancellation Notice: The member must notify the cancellation or rescheduling request of a scheduled session at least forty-eight (48) hours in advance of the appointment time.

2.2. Late Notice or No-Show Penalty:

  • If the Member fails to give 48-hour notice or does not attend the session, they will have one (1) opportunity to reschedule it within the same calendar month, subject to studio availability.
  • If the Member fails to attend the rescheduled session or cancels again without prior notice, the session for that month will be irrevocably forfeited with no refund or carryover.

2.3. Member Tardiness: Sessions will begin and end at the scheduled time. Any delay by the member will result in a non-refundable reduction of the session duration. For example, if the member arrives 20 minutes late, their session will be shortened by 20 minutes.

3. Membership Commitment, Renewal, and Termination

The payment obligation is for 6 months, but the residual payment policy varies depending on the type of plan:

A. Content Creation Plans — If the member wishes to terminate before the end of the contract, the residual payment scheme applies: 1 month used = 5 months to pay; 2 months = 4 months; 3 months = 3 months; 4 months = 1 month; 5 months = 0 months (termination without residual payment, but services forfeited).

B. Photo Plans — If the member wishes to terminate before the end of the contract, they must pay 100% of the remaining months' fees to complete the 6-month obligation period.

C. Renewal Policy — The membership does not automatically renew at the end of the 6-month period. If the member wishes to continue, they may request renewal for a new six (6) month period, subject to the current rates.

5. Additional Production Services

5.1. Availability: All plans can include professional makeup, hairstyling, and image consulting services.

5.2. Cost and Booking: These services cost between $150 and $300 USD depending on the specific requirements. Members must request and confirm the extra service at the time of booking.

5.3. Premium Plan: The Premium Membership plan already includes makeup and hairstyling as part of the monthly fee.

6. Subscription Mechanism

  • Accept these Terms and Conditions through the digital contract.
  • Once subscribed and the initial payment is made, the member may schedule their session through the booking system for available dates or contact directly via the WhatsApp link to coordinate the session details and date.

Acceptance of Terms

By accepting these Terms and Conditions, the member acknowledges having read, understood, and agreed to all clauses contained in this document. Waytofilm reserves the right to modify these Terms at any time. Any changes will be communicated to the member with at least thirty (30) days' notice.
